Introduction

These Terms & Conditions ("Terms") govern your access to and use of the Petfolio website (the "Site") and any orders placed through it. By using the Site or placing an order, you agree to be bound by these Terms. If you don't agree, please don't use the Site or our services.

Definitions

"Customer" means any individual or entity making a purchase on the Site. "Products" means all items offered for sale, including personalized photo books. "Order" means a purchase of Products made through the Site. "Intellectual Property" means all content, designs, illustrations, text, logos, images, photographs, and other work created or owned by Petfolio.

Using the Site

By accepting these Terms, you confirm that you are at least 18 years old, or if you're a minor, that you have permission from a parent or legal guardian. You agree not to use the Site or Products for any unlawful purpose, and not to copy, reproduce, resell, or otherwise exploit any part of the Site or its content without our prior written consent. Violating this may result in suspension of your access to the Site and legal action.

Orders & Payment

Orders are confirmed only once payment has been received in full. A confirmation email serves as proof of your Order. We reserve the right to cancel any Order in cases of suspected fraud, technical error, product unavailability, or non-payment. Prices are listed in the currency shown at checkout and include any applicable taxes. Payments are processed through Shopify Payments, Stripe, or PayPal.

Intellectual Property

All designs, illustrations, covers, and creative elements of Petfolio Products are the exclusive property of Petfolio. Any reproduction, distribution, modification, adaptation, transmission, or use, in whole or in part, without our prior written permission, is strictly prohibited. Petfolio reserves the right to pursue damages for any unauthorized use.

Limitation of Liability

Our liability for any Product is limited to the amount actually paid by the Customer for that Product. We are not liable for any indirect, incidental, or consequential damages, including loss of profits, loss of data, or business interruption, except where mandatory consumer protection laws provide otherwise.

Personal Data & Privacy

Personal data is collected and processed in accordance with our Privacy Policy and applicable data protection laws. By using the Site, you consent to these practices, including the use of cookies. You have the right to access, correct, delete, and request portability of your data by contacting us at contact@trypetfolio.com.

Quality Guarantee

All Petfolio books come with a 60-day quality guarantee from the date of delivery, without prejudice to any statutory consumer rights that may apply in your country of residence. This guarantee covers manufacturing defects, including print quality, binding, and materials. It does not cover normal wear and tear, accidental damage, damage from improper use, or minor color variations due to screen calibration differences (an inherent part of the printing process, not a defect). To make a claim, contact us at contact@trypetfolio.com with a description and photos of the issue. If the defect is confirmed, we'll send a replacement at no extra cost. A refund will be issued within 14 business days via the original payment method only when a replacement isn't possible.

Returns & Defective Products

Because our Products are personalized, we don't accept returns except in the case of a verified manufacturing defect. In that case, the Product will be remade and reshipped at no cost. Defects must be reported within 60 days of delivery. This is without prejudice to any statutory consumer rights you may have under the laws of your country of residence.

Right of Withdrawal

Because Petfolio books are made to order using photos and content you provide, they are custom, personalized goods. As such, and in line with standard consumer protection exemptions for made-to-order items, the standard right of withdrawal does not apply once production has begun. By confirming your order, you acknowledge and accept this.

Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control, such as natural disasters, strikes, government actions, or internet outages.

Governing Law

These Terms are governed by the laws applicable to Petfolio's place of business. As a seller serving customers internationally, we also honor any mandatory consumer protection rights applicable in your country of residence, regardless of these Terms.
